By accessing or using the ZeroBooks mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

ZeroBooks is an AI-powered educational platform that provides:

  • AI-generated educational courses and lessons
  • Interactive learning content including videos, quizzes, and flashcards
  • Personalized learning experiences
  • Progress tracking and achievements
  • Community features and referral programs

3. User Accounts

3.1 Account Registration

  • You must create an account to access certain features of the App
  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

3.2 Account Security

  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscriptions and Credits

4.1 Subscription Plans

  • The App offers both free and premium subscription tiers
  • Subscription fees are billed through your App Store or Google Play account
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Refunds are subject to the policies of the App Store or Google Play Store

4.2 Credits System

  • Certain features require credits for use
  • Credits may be purchased, earned through referrals, or included in subscription plans
  • Credits are non-transferable and non-refundable
  • Credits have no cash value

4.3 Free Tier Limitations

  • Free tier users may have daily limits on lesson access and feature usage
  • We reserve the right to modify free tier limitations at any time

5. AI-Generated Content

5.1 Content Generation

  • The App uses artificial intelligence to generate educational content
  • AI-generated content is provided "as is" and may contain errors or inaccuracies
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • You are responsible for verifying the accuracy of information before relying on it

5.2 Content Ownership

  • You retain ownership of any content you create or upload to the App
  • By using the App, you grant us a worldwide, non-exclusive license to use, store, and display your content for the purpose of providing the Service

5.3 Our Content

  • All educational content, software, code, and materials provided by ZeroBooks are our property or our licensors' property
  • You may not copy, modify, distribute, or create derivative works from our content without permission

6. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Attempt to gain unauthorized access to the App or related systems
  • Interfere with or disrupt the App's operation
  • Use automated systems (bots, scrapers) to access the App without permission
  • Share or distribute content in violation of copyright or other laws
  • Manipulate the credit or referral system
  • Create multiple accounts to abuse promotions or referral bonuses

7. Referral Program

7.1 Program Terms

  • Users may earn credits by referring new users to the App
  • Referral rewards are subject to tiered credit amounts based on total referrals
  • We reserve the right to modify or discontinue the referral program at any time
  • Fraudulent referral activity will result in account suspension and forfeiture of credits

7.2 Referral Rewards

  • Credits are awarded when a referred user creates an account and meets qualifying criteria
  • We reserve the right to verify and validate referral activity
  • Referral rewards may be adjusted or revoked if fraudulent activity is detected

8. Third-Party Services

The App integrates with third-party services including:

  • Payment processors (App Store, Google Play, RevenueCat)
  • Content delivery networks
  • AI service providers
  • Analytics services

Your use of these services is subject to their respective terms and conditions.

9. Privacy

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEROBOOKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or similar harmful code
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted or shared through the App

13. Indemnification

You agree to indemnify, defend, and hold harmless ZeroBooks, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the App

14. Termination

14.1 Termination by You

  • You may delete your account at any time through the App settings
  • Cancellation of subscription does not entitle you to a refund of unused credits or subscription fees

14.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse the App or its features
  • Remain inactive for an extended period

14.3 Effects of Termination

  • Upon termination, your right to use the App ceases immediately
  • We may delete your account data in accordance with our Privacy Policy
  • Provisions that by their nature should survive termination shall survive

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through:

  • In-app notifications
  • Email notifications
  • Updated "Last Updated" date at the top of these Terms

Your continued use of the App after changes constitute acceptance of the modified Terms.

16. Changes to the Service

We reserve the right to:

  • Modify or discontinue any feature or service
  • Change pricing and subscription plans
  • Update credit costs for features
  • Modify referral program terms

We will provide reasonable notice of material changes to the Service.

17. Geographic Restrictions

The App is provided from Kapybara - 552, Sector 3, HSR, Bengaluru, KA, India and is intended for users worldwide. We make no representation that the App is appropriate or available for use in all locations. Users who access the App from other locations do so at their own risk and are responsible for compliance with local laws.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

18.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Good faith negotiation between the parties
  2. Binding arbitration if negotiation fails
  3. Litigation in the courts of India as a last resort

19. Children's Privacy

The App is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately.

20. Export Control

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce.

21. Miscellaneous

21.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZeroBooks regarding the App.

21.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

21.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

21.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

21.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from causes beyond our reasonable control.

21.6 Language

These Terms may be translated into other languages. In case of conflict between the English version and a translation, the English version shall prevail.
